Attorney Barclay helped a client charged in connection with allegedly submitting fraudulent mortgage loan applications receive a probation sentence despite a prison recommendation by the United States Government. His client pleaded guilty to a charge of conspiracy in violation of Title 18, United States Code, Section 371. He faced a possible sentence of up to five years in prison. Attorney Barclay's skillful negotiations with the prosecution and a lengthy sentencing memorandum on behalf of his client resulted in a sentence of five years' probation and $41,460.60 restitution.

Charge: 3 Counts of Unlawful Distribution of A Controlled Substance

Court: Jefferson County District and Circuit Courts, 2014-2017

Facts: Client sold small amounts of marijuana to an undercover Vestavia Hills Narcotics Agent several times over the course of a few months.

Result: With a plea to one count and two counts dismissed, the only punishment per the terms of the plea agreement (except Court Costs) was two years of unsupervised probation.

Charge: Trafficking Morphine/Heroin and 2 Counts of Unlawful Distribution of a Controlled Substance

Court: Jefferson County District and Circuit Courts, 2013-2017

Facts: Client sold opiod pain medication to an undercover narcotics officer on a number of occasions and confessed to having done so thereby confessing to violating a number of Alabama's drug laws.

Result: This case began in 2013 and procedurally moved from District Court to Circuit Court where after preparing the case for trial, Mr. Barclay negotiated a plea with the State of Alabama resulting in Client receiving three years of unsupervised probation for one of the charges with the other two dismissed.

Charge: DUI, Resisting Arrest

Court: Birmingham Municipal Court

Facts: Client was asleep in his vehicle on the side of the highway when spotted by Birmingham Police. Birmingham PD reached into the vehicle to wake client and client responded by grabbing the Officer's hand. The Officer struck the client in the face and removed him from the vehicle and placed him under arrest for DUI and Resisting Arrest.

Result: Following negotiations with the Prosecutor, all charges were dismissed.

Charge: Felony Possession of Marijuana in the First Degree, Unlawful Possession of Drug Paraphernalia and number of traffic tickets.

Court: Limestone County District Court

Facts: Client was stopped for speeding and subsequently was charged with the aforementioned offenses.

Result: Mr. Barclay's negotiations with the Prosecutor resulted in the Felony Marijuana charge and all traffic tickets being dismissed in exchange for client pleading guilty to Possession of Drug Paraphernalia and paying Court Costs on just that one charge.

Charge: Unlawful Possession of Marijuana in the Second Degree, Unlawful Possession of Drug Paraphernalia

Court: Trussville Municipal Court

Facts: Client and several friends were sitting in a parked automobile on a dead end street at around 10:00 p.m. smoking marijuana when Trussville PD approached the vehicle and placed everyone under arrest.

Result: At the first Court appearance, Mr. Barclay was able to secure an outright dismissal of both charges upon payment of Court Costs with no other conditions for dismissal.

Charge: Theft of Property Third Degree (now Fourth Degree)

Court: Hoover Municipal Court

Facts: Client was arrested following stealing merchandise from Walmart.

Result: Mr. Barclay negotiated a settlement whereby client participated in a deferred prosecution program resulting in the dismissal of the charge.

Court: Mountain Brook Municipal Court

Facts: Client was pulled over in the early morning hours and charged with DUI; when transported to the station he refused to take the breath test.

Result: Following client's completion of terms negotiated by Mr. Barclay and the Prosecutor, the DUI charge was dismissed.

Charge: Mortgage Fraud

Court: United States District Court For The Northern District of Alabama

Facts: Client was implicated in scheme to qualify for millions of dollars of loans to purchase property at Lake Martin by overstating income and failing to report liabilities on loan applications. Loans to a number of others involved were made by lending institutions with one bank suffering losses from which it could not recover.

Result: Through diligent work with the United States Attorney's Office for the Northern District of Alabama, Mr. Barclay argued successfully at sentencing for a probationary sentence for his client.

Court: Columbiana Municipal Court

Facts: Client was stopped for a traffic violation and found to be in possession of marijuana.

Result: Through negotiations, Mr. Barclay was able to reach a dismissal upon his client's completion of Court Referral Program.

Facts: Client was found to be in possession of marijuana after being stopped for a traffic violation.

Result: At the first and only Court appearance, Mr. Barclay was able to negotiate an outright dismissal of all charges.

Charge: Trafficking Opium/Opium derivatives

Court: Jefferson County District Court

Facts: Client was involved in obtaining some 25,000 opioid pain pills illegally and, along with a Physician who was prosecuted by the Federal Government, was prosecuted with six other co-defendants.

Result: Despite client having more than three prior felonies, Mr. Barclay negotiated the reduction of the Trafficking charge, a class A felony, to Conspiracy to Unlawfully Possess a Controlled Substance. The charge could have put the client in prison for the rest of his life but instead he anticipates serving approximately three years in prison.

Charge: Unlawful Possession of a Controlled Substance, Felony Possession of Marijuana in the First Degree, Chemical Endangerment of a Child

Court: Shelby County District and Circuit Court

Facts: Client and husband had a grow operation in their house where their children lived attempting to cultivate marijuana and psilocybin mushrooms.

Result: As Mr. Barclay prepared for trial, ongoing negotiations resulted in a resolution through which Client was able to keep her children and all felonies were dismissed in exchange for pleas to misdemeanor marijuana possession and possession of paraphernalia.

Facts: Client and her boyfriend were found by police arguing in the street and client struck boyfriend in the face at which point she was placed under arrest.

Court: Birmingham Municipal Court

Facts: Client was asleep in his car and found to be in possession of a syringe when Police arrived to investigate complaints from citizens who witnessed client asleep in car.

Result: Charge dismissed outright the day the matter was to go to trial.

Charge: Public Intoxication

Court: Tuscaloosa Municipal Court

Facts: Client was removed from popular college bar by police for being rowdy and failing to comply with orders of law enforcement and subsequently was arrested for public intoxication.

Result: Client, a resident of Wisconsin who was only visiting Alabama for one weekend, did not have to appear in Court and Mr. Barclay negotiated a dismissal upon completion of 8 hours of community service.

Charge: Theft of Property 3rd Degree (Misdemeanor, now 4th Degree)

Court: Sumiton Municipal Court and on appeal to the Circuit Court of Walker County

Facts: Client was arrested at Walmart after crossing the point of sale with items he had not purchased.

Result: As Mr. Barclay and his client prepared for trial, the Prosecution dismissed the charge as Mr. Barclay was able to convince the Prosecution that client's conduct did not meet the elements of the crime with which he was charged.

Court: Vestavia Hills Municipal Court

Facts: Client was arrested for suspicion of intoxication while working at a residence in Vestavia Hills.

Result: Mr. Barclay negotiated the dismissal of the charge upon the client's attendance of six self help meetings.

Charge: Public Intoxication, Minor in Possession of Alcohol

Court: Homewood Municipal Court

Facts: Client was at his place of employment, a restaurant, where he was found to be intoxicated and in possession of alcohol which resulted in his arrest.

Result: At the first and only Court appearance, Mr. Barclay secured adjudication as Youthful Offender for his client and had the public intoxication charge dismissed.

Facts: Client arrested for DUI and breath test revealed elevated blood alcohol (greater than .15%).

Court: Adamsville Municipal Court

Facts: Client exited Walmart with a battery for his RV without paying for it because he wanted to make sure it was the correct size but nonetheless he was arrested and charged with misdemeanor Theft of Property.

Result: Mr. Barclay handled this case for the client in absentia as he lives on the other side of the country; upon negotiation with the Prosecutor, the charges were dismissed upon payment of Court Costs.

Court: Bessemer Division of Jefferson County District Court

Facts: Client was asleep in his car outside of his house and upon being approached by Bessemer PD, he was arrested for public intoxication.

Result: Despite client having as many as ten alcohol related arrests, Mr. Barclay negotiated a dismissal of the charges upon payment of Court Costs at the first and only Court appearance.

Charge: Unlawful Possession of a Controlled Substance (felony)

Court: Shelby County District and Circuit Court

Facts: Client, non-Alabama resident, was at a local music venue, Oak Mountain Amphitheater in Pelham, Alabama at a Phish concert when undercover Narcotics Officers arrested client for possession of LSD and Adderall without a prescription.

Result: Following negotiations with the Prosecutor, Mr. Barclay's client was able to participate in a brief monitoring program in client's home state and a misdemeanor plea was reached - client could have continued in monitoring and had all charges dismissed but chose to take the misdemeanor plea to conclude further entanglement with the Court in Shelby County.

Facts: Client, non-Alabama resident, was arrested outside of Lakeview area bar and charged with public intoxication.

Court: Calera City Court

Facts: Client struck tractor parked on side of the road at 3:00 a.m. which was witnessed by off duty police officer. Client did not stop and was arrested and charged with DUI and leaving the scene.

Result: Following several settings at which Mr. Barclay negotiated with the Prosecutor, the DUI was dismissed and the other ticket was reduced to failure to render for which client paid a small fine.

Court: Montevallo City Court

Facts: Client was arrested in his car outside of a bar around 1:00 a.m. and blew over the legal limit triggering the implied consent administrative license suspension.

Result: The administrative suspension was successfully challenged and client's driving privileges were not impacted by arrest; DUI dismissed following negotiations with Prosecutor.

Facts: Client sold a number of prescription pills to a confidential informant.

Result: Mr. Barclay found a way to allow his client to remain free despite client having several drug convictions in client's past including Trafficking Cocaine and Unlawful Possession of a Controlled Substance. Further, the Distribution charge being a "guidelines" offense called for a lengthy prison sentence however Mr. Barclay was able to negotiate a plea deal whereby client remains free and final adjudication will take place at a probation hearing in December.

Facts: Client arrested after a call was placed to law enforcement following an argument with his wife.

Result: All charges dismissed at first Court appearance following negotiations between Mr. Barclay and the Assistant District Attorney.

Charges: DUI, Driving on Wrong Side of Highway, Open Container Violation, No Seat Belt

Court: Butler County District Court

Facts: Client was stopped by an Alabama State Trooper for driving the wrong way on an exit ramp off of Interstate 65. After being stopped, various open containers of alcohol were found in the client's car for which he was issued a citation, as well as one for not wearing a seat belt. The client was arrested and charged with DUI. After being arrested, client refused to take a breath test to measure his blood alcohol content.

Result: The client applied for and was denied entry into the Court's pre-trial diversion program. After this denial, Mr. Barclay was able to have the DUI and Driving on the Wrong Side of Highway charges outright dismissed following negotiations with the Assistant District Attorney. The client paid a small fine for failure to wear a seat belt.

Result: Mr. Barclay was able to negotiate a deal whereby the charges will be dismissed following the client's completion of certain requirements as agreed upon by Mr. Barclay, his client and the Assistant District Attorney.
