Levels of drug crimes

Drug crimes don’t just apply to drug dealers – possessing marijuana for personal use in Alabama is a Class A misdemeanor on first offense, and can be a Class C felony as a subsequent offense.  Even unlawful possession of a prescription medication can be a crime. Moreover, a criminal drug conviction will hang over you for years, affecting everything from your ability to get a job to your ability to vote.

Penalties for convictions of drug crimes in Alabama can vary by drug type, amount of drug, involvement of minors, involvement of weapons and the type of crime perpetrated:

Felony drug crimes

  • Class A felony involving a deadly weapon: no less than 20 years in prison
  • Class A:  10 years to life in prison and up to $60,000 in fines
  • Class B or C felony with a deadly weapon: no less than 10 years in prison
  • Class B: two to 20 years in prison and up to $30,000 in fines
  • Class C: one to 10 years in prison and up to $15,000 in fines

Misdemeanor drug crimes

  • Class A: up to one year in county jail and $6,000 fine
  • Class B: up to six months in county jail and $3,000 fine
  • Class C: up to three months in county jail and $500 fine

Penalties for federal crimes are available on the Drug Enforcement Administration website.

Ready for trial and enforcing your rights

Every fact is important because an error by police or prosecutors may be sufficient to get your charge dismissed or substantially reduced. At the very least, any imperfection in the prosecution’s case can lead to a case dismissal or a beneficial plea bargain with alternate penalties like work-release or community service. Your criminal lawyer must have full insight into Title 13A of the Alabama Criminal Code, and in-depth experience with the state’s Courts can create such a result. And that insight and experience is what you get with Barclay Law LLC.
