Ignition interlock and double minimum punishment in Alabama

On June 9, 2011, Gov. Robert Bentley signed into law Act 11-613, the ignition interlock bill (HB 361), and Act 11-621, the double minimum punishment bill (SB 67), both effective September 1, 2011. However, the implementation date for the ignition interlock act will not start until one year later, on September 1, 2012. These acts change and add new sections to Alabama Code Section 32-5A-191, and include these provisions:

  • If your blood alcohol concentration (BAC) is shown to be 0.15% or greater while operating a vehicle, you will be sentenced to double what you have received if your BAC had been less than 0.15%.
  • If such a conviction is your first offense, your license will be suspended for at least one year.
  • If your license has been suspended, you cannot get it back unless you pay for and have periodically checked a special interlock device installed on your ignition; you must blow into this device each time you turn the key, and your car will not start if your BAC is 0.02% or higher.
  • Minimum jail time and fines for multiple DUI offenses are greatly increased, up to minimums of 120 days and $8,200 as the Court decides.

Early legal career

Mr. Barclay has extensive experience as a litigator, beginning his legal career after graduation from the University of Alabama School of Law by serving as law clerk to The Honorable Robert S. Vance, Jr., Judge in Alabama’s 10th Judicial Circuit (Jefferson County). He served as court-appointed criminal defense counsel and practiced with two respected Alabama law firms before establishing Barclay Law LLC. The foundation of Mr. Barclay’s legal practice is his commitment to work in partnership with his clients while providing quality, attentive service. He understands that many people who rely on him for help are not familiar with the legal system, and he advises them through aggressive advocacy and full defense of their legal rights.

A native of Birmingham, Alabama, Mr. Barclay has deep roots in the community. He volunteered for the public defender's office and the Red Cross when he was in law school in Tuscaloosa. He is a member of the Alabama Association for Justice, the Birmingham Bar Association, the State Bar of Alabama and other local civic organizations. With a true statewide practice, he continues to expand his client representation throughout Alabama as client needs dictate.
